Rule 7
Applying for a labor permit
(1) Before employing a foreign national, an employer must apply to the department for a labor permit in accordance with schedule-1.
(2) When making an application according to sub-rule (1), the following details and documents should be attached to the application:-
(a) According to sub-section (3) of section 22 of the Act, a copy of the following publicly published advertisement:...
(1) Posts required for establishment, number and main work to be done,
(2) Required minimum educational qualifications, experience and training,
(3) Selection Method,
(4) Last date and place of submission of application,
(5) Details and documents etc. to be attached to the application (b) Attested copy of passport (valid for at least six months),
(c) Personal details (biodata) of the foreign national concerned (d) Evidence that the employer has paid the tax due in accordance with the prevailing law,
(e) If any Nepalese citizen has applied according to the advertisement made in accordance with clause (a), a brief description of such applicant's qualification, efficiency and labor selection process,
(f) action plan to replace foreign workers by making Nepalese citizens skilled,
(i) If work consent of the Government of Nepal, Ministry of Home Affairs is required, a copy of such work consent letter.
(3) The employer shall also place the advertisement published in accordance with sub-section (3) of section 22 of the Act on the employment portal of the Ministry.
